Terms & Conditions Part 1 (Customers/end users/purchasers of the services or products from Solid o2 equipment or this website)

Welcome to Solid o2!

These terms and conditions govern your use of our website and the purchase of our Solid o2 Oxygen treatments (AKA: mild hyperbaric oxygen treatments). By accessing or using our website and making a purchase, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please refrain from using our website and making a purchase. Once such use has occurred you are bound to such terms and conditions until such time as any such term or condition is amended or cancelled by agreement between the parties, which amendment or cancelation will be in writing, or in such other manner as termination of its operation may be determined in terms of this agreement.

  1. Purchase Validity and Cancellation

1.1 All purchases of Solid o2 oxygen treatments are valid for a period of 6 months from the date of purchase, unless otherwise stated.

1.2 In the event of a cancellation, a reasonable cancellation fee may apply. The specific amount will be determined by SolidO2, based on reasonable and industry specific considerations, and communicated to you at the time of cancellation.

1.3 Bookings cancelled within less than 24 hours of the scheduled appointment date and time will be charged in full at the customer’s expense.

  1. Refund and Cancellation Policy: Included but not limited to Single treatment and Pack Purchases

2.1 Pack purchases of Solid o2 oxygen treatments may be available at a discounted rate. Please note that refunds for pack purchases are calculated based on the treatments that have been actually taken, and therefore, refunds are not issued on a pro-rata basis.

2.2 Cancellations of any purchase will incur a 20% non-refundable deposit payment.

2.3 The refund amount will be determined by deducting the individual treatment cost (not at the pro-rata value of the pack) for the treatments that have already been used from the total pack purchase price.

2.4 The below is simply an illustration example of how a refund is to be calculated on a purchase. 
In this example the purchase is a 5 pack for R1980.  Should the client attend 1 session and then require a refund.  The refund will be calculated like this:  

  • The payment value of R1980 less the 20% (R396) online deposit fee of which is non-refundable
  • The balance of R1584 is with the site who is responsible for your refund may deduct the single session taken of R495 (current single session price)
  • Total refund due to client after cancellation is = R1089

If the client paid for the pack at the site/location/franchisee, then the Franchisee is responsible to refund the client according to these terms and conditions (franchisees do not have to pay Solid o2 Pty Ltd any fees for walk in clients but they will also charge for their 20% cancellation/transaction fee).  If the client paid for the pack online this website, then Solid o2 will refund the client in the same calculations.

  1. Refund Disputes

3.1   All treatment purchases through Solid o2 Pty Ltd are funded to the allocated franchisees/sites as soon as possible and hence customers agree to not hold Solid o2 Pty Ltd responsible for their refund but we will try to assist in any disputes with any of our Franchisees.

3.2  In relation to the nature of point 3.1 above, all Franchisees accept responsibility to refund clients in the same manner as put in these terms and conditions.

3.3  For any refund disputes or inquiries, please contact us at admin@solido2.co.za. We will investigate the matter promptly and provide a resolution as per our policies and guidelines.

  1. Changes to Terms and Conditions

4.1 Solid O2 reserves the right to modify or amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these terms periodically to ensure your continued agreement with them.

  1. Governing Law

5.1 These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.

By using our website and making a purchase, you acknowledge that you have read, understood, and agree to these terms and conditions. This includes our commitment as to data privacy:

“Solid O2 use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.”

Affiliates/)

Our online services include services and products listing under our website at www.solido2.co.za

Now all “Solid o2 Connect” Clients can earn additional revenue/commission when their customers use a unique coupon code. Registration to the Solid o2 Connect Program includes these services and is free. You can earn commission when your coupon is used by your customers.

Cancellations:  At Solid O2, we are committed to offering more than just a product delivery; we provide a range of additional services at no extra cost to our Solid o2 Connect client base. We value our relationships with our clients deeply, believing they transcend mere contractual agreements. Therefore, if you (the Client) wishes to discontinue participation in the Solid O2 Connect program, you may cancel at any time with one month’s notice. 

Definitions:

Client(s): Refers to any owner, user, or operator of an oxygen therapy chamber, or any affiliate of Solid O2. For example, an individual or company that purchases an oxygen therapy chamber and offers oxygen treatments to the public is considered a Client of Solid O2. Similarly, an athlete or social influencer who promotes Solid O2 services or products also qualifies as a Client of Solid O2.

Customer/End User: This term refers to any individual or individuals who purchase or utilize treatments, products, or consultations provided through Solid O2’s equipment or online services. For example, a person who buys an oxygen treatment from a client, or who purchases services or products through the Solid O2 website, is considered a Customer (End User).

Solid O2 Connect Program (So2 Connect): This program encompasses all additional services and products, both free and paid, offered by Solid O2 to the Client. These include, but are not limited to, free and paid online advertising funded by Solid O2, organic social media posts, lifetime access to a dedicated WhatsApp support group, and the opportunity for clients to earn commissions through online sales of services and products.

Solid O2 reserves the right to terminate a client’s participation in the So2 Connect program for reasons deemed justifiable, including but not limited to, conflicts of interest that may negatively affect the brand image or relationships with other members of the So2 Connect network.

Solid O2 is proud to offer a complimentary business solution akin to a free franchise, fostering a shared commitment to upholding the highest standards of our brand. This successful model remains unchanged and will continue to drive our growth as the fastest-growing entity in the industry. However, to sustain our momentum, certain adjustments are necessary to ensure synergy across our sites in terms of mind-set, client treatment approach, online presence, and physical appearances.  As Solid o2 Pty Ltd evolves to give great service to both treatment and chamber purchase clients, some elements/values/attributes may change, be added or removed and hence some images/text etc may display elements/values/attributes that are not given/changed or given and as a free business solution, Solid o2 is not held liable and/or forced to offer these online services/elements/attributes.

Solid o2 My Health (MyHealth):  The My Health department is a new range of services and products (under the Solid o2 Connect Program) sold via the Solid o2 website to assist in generating additional revenue for Clients.

Price Guide: The Price Guide serves not as a definitive price list but as a reference for Solid O2 sites participating in the Solid O2 Connect program. It is a pricing system for treatments, enabling sites to create special offers or discounts based on the guidelines provided. Clients must adhere to the prices in the Price Guide when charging customers to maintain consistency and synergy among all network members in the Solid O2 Connect program.  All sites may only change the pricings if they are combining a service or product that is sold from their practice/site.

Considerations:
1. Home vs. Business: If you are running or starting a treatment centre, Solid O2 Connect is the ideal choice. For those seeking the chamber alone, including delivery, setup, and basic operational training, the Standard option is recommended for home use (No Solid o2 Connect program).

  1. Area Licenses: Our strategy focuses on encouraging new clients to open centres in locations further away, rather than losing sales to competitors. This approach increases the likelihood of gaining new sites that can market and sell treatments in synergy with us. We strongly advise new sites to open within a reasonable distance from existing ones. Limiting the purchase of a Solid o2 solution will lead to competitor growth instead of network growth and hence we continue to grow coverage and work hard on increasing turnover for all sites.
  2. Special Needs: Inspired by Jaden Ashton Pothier, every Solid O2 site commits to providing a 10% discount above any existing prices or discounts, allowing parents to accompany their child’s treatment free of charge. Further details are available in the full story.
  3. Solid O2 Marketing: At no additional cost to our sites, Solid O2 provides both organic and paid marketing efforts to enhance online sales. We reserve the right to modify the Price Guide to maintain uniformity across all locations and to align with industry standards. Additionally and due to Solid O2 online costs and efforts, Solid o2 may issue online discounts, coupons, and vouchers lower the Price Guide to boost sales and grow our client base. For transactions conducted online via the Solid O2 website or payment platform, a nominal commission is retained to support our marketing efforts, including covering any associated card transaction fees.
  4. Fees: Whether for home use or adding to an existing business or starting a new one, Solid O2 does not charge any fees upfront. However, as Solid O2 head office incurs costs related to treatment campaigns, Visa/MasterCard website, SEO, and other online optimization and maintenance efforts, we retain a commission only when we secure a sale for you. Our aim is to generate revenue for you before covering our costs. Currently, the commission rate is set at 20% of any sale obtained through our online efforts, payment platform, call centre, etc unless otherwise agreed in writing.
  5. Additional Benefits: Please refer to the “Solid O2 Connect Program” for a comprehensive list of free benefits, including online assistance and website listing of your branch/business on our website. These benefits come with lifetime support to ensure the safe and effective use of our equipment, safeguarding both your customers and our brand.
  6. Higher Pressures and Modifications: Each country has its own regulations regarding mild and high pressures. Clients are responsible for operating, registering, and paying any fees associated with pressures outside the standard offerings. In South Africa, pressures equal to or above 1.5ATA are the client’s responsibility, not Solid O2.
  7. Sale Assistance: Should you wish to sell your chamber, Solid O2 offers sales assistance while preserving the integrity of the brand. You can sell the chamber independently or with our support (throw our network/connections), with a Solid O2 fee of R5000 (excluding transportation costs) to cover installation, inspection, and training of the new site. The new client will also receive a warranty renewal for the remaining period of the initial warranty period or an extension of 6 months if the warranty has expired.
  8. Requirements: As part of our Solid o2 Connect network, we function as a team to ensure the brand’s growth and the success of your branch. This entails simple tasks such as sharing positive lines on our social media platforms, sharing posts and advertisements on your own social media platforms, providing excellent service to maintain the brand’s integrity, and ensuring that only trained staff members treat the public and operate the equipment. All posts and advertisements must be approved by Solid O2.
  9. Site Review: To be listed as a Solid O2 preferred treatment centre, a site review is mandatory to maintain a professional environment and synergy across all sites.

Please note that while product specifications, quality, and offered services will always match what is quoted and invoiced, images shared in quotes, invoices, and electronic communications may differ slightly from the actual product delivered.

  1. Commissions/bonuses/rewards: All extra profits from commissions, bonuses, rewards and other bonuses through the Solid o2 online services will only be paid out monthly if the accumulated earnings is greater (>) than R200.  If the accumulated funds over every 6 months of the year are not over R200 the report is closed and now pay-outs will be made to the client.  Accumulated funds are closed on the end of June and December every year.

By participating in our network (the Solid o2 Connect Program), a powerful network of like-minded individuals committed to helping others through these incredible treatments, you will showcase the professionalism of our brand through our collaborative efforts.

In the event of any discrepancies between quotes, invoices, emails, or other forms of electronic communication and these terms, Solid O2 reserves the right to correct such errors through written notice to the client.

It is crucial for all existing and potential sites to thoroughly read and understand these important provisions. If Solid O2 finds that a client is not operating in the best interest of the public, reputation, intellectual property of the brand, or if they purchase an alternative mild hyperbaric oxygen brand after setting up a Solid O2 site (causing a conflict of interest), we reserve the right to require the removal of all Solid O2 representational artwork, posters, signage, and online images associated with the Solid O2 brand. This includes Facebook pages, Instagram, and other online platforms featuring the Solid O2 name or related images. We strive for the success of all our sites within the professional and high-quality brand synergy, and any breach of these terms may result in accountability for damages.

Should a Client cancel from the Solid o2 Connect program or be removed by Solid o2.  Solid o2 reserves the right to retain all online bonuses, commissions, and rewards for any online services/products.  The Client may lose the right to the use of any of Solid o2’s branding, images, content, slogans, Solid o2 company name or referencing to, including social media platforms that may include part or whole of the Solid o2 brand, name, slogan or content.

Please note that cancellation of the Solid o2 Connect program does not release you from any outstanding obligations or agreements that were in effect prior to cancellation.
